1. Introduction

This Terms of Service ("Agreement") governs the use of the WhatsApp integration service
with ERPNext, provided by Agkiya Technologies and Consulting LLP (“Provider”, “We”, “Us”, or “Our”). By using this service, the client (“User”, “You”, or “Your”) agrees to the terms and conditions outlined in this document.

2. Scope of Service

Our WhatsApp integration allows ERPNext users to send automated notifications via WhatsApp based on predefined triggers within the ERP system. This includes, but is not limited to:

Order Confirmations

Payment Receipts

Invoice Notifications

Shipment Updates

Customer Support Messages

3. Compliance with WhatsApp Policies

By using this service, You agree to comply with WhatsApp’s Business Policy, Commerce Policy, and Terms of Service. Any violation of WhatsApp’s guidelines may result in suspension or termination of access to the integration.

4. Data Privacy and Security

We do not store or retain any personal data beyond what is necessary for service operation.

All messages transmitted via WhatsApp are subject to WhatsApp’s encryption and security policies.

Users are responsible for ensuring that customer data shared through WhatsApp complies with applicable data protection laws, including but not limited to GDPR and India’s IT Act.

5. User Responsibilities

Users must obtain prior consent from recipients before sending WhatsApp messages.

Users must ensure messages are not spam, misleading, or in violation of any applicable laws.

Users are solely responsible for the accuracy and legality of the messages sent through the integration.

6. Service Limitations

We do not guarantee the delivery of messages, as it depends on WhatsApp’s infrastructure and recipient settings.

WhatsApp may impose restrictions on message volume, content, or frequency.

We are not responsible for any technical disruptions or downtime affecting the integration.

7. Fees and Payments

The integration may be subject to a one-time setup fee and/or ongoing subscription charges.

Additional charges may apply based on WhatsApp’s pricing model, including per- message costs.

8. Termination and Suspension

We reserve the right to suspend or terminate this service under the following conditions:

Violation of WhatsApp’s policies or terms.

Non-compliance with legal or regulatory requirements.

Misuse of the integration for spam or fraudulent activities.

9. Liability Disclaimer

We are not liable for any direct, indirect, or consequential damages resulting from the use of this integration.

Users assume full responsibility for any legal or compliance issues arising from WhatsApp communications.

10. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of India. Any disputes arising under this
